High Cost Mortgages

Hi Tyler, I had a question regarding high-cost mortgages. It is my understanding that one of the thresholds for a high-cost mortgage is that the prepayment penalties exceed 36 months or exceed 2% of the prepaid amount. However, in other areas I have seen that high-cost mortgages are prohibited to have prepayment penalties. I'm looking for a little clarification on how this is possible, for a high-cost mortgage to not be allowed to have prepayment penalties when that is in fact one of the thresholds for a mortgage to be considered high-cost? Thank you.
